TERMS & CONDITIONS OF BUSINESS The following Terms & Conditions apply immediately upon meeting an Au Pair through this Agency, or on reading the details of an Au Pair whose application has been sent in the post, faxed or emailed by this Agency, whether the family application form has been signed by the family, or not. Payment in advance of the fee is construed as automatic acceptance of the Terms and Conditions of Business. The Agency reserves the right to refuse a family, or to remove the Au Pair when the following terms and conditions have not been adhered to. Should au pair details be passed to another family by the recipient family, the agency fees become payable by the other family and in the event of the new family not paying the fees, the recipient family becomes liable and action will be taken to recover said fees. This includes failure to pay the Agency fee. PLACEMENT FEES IN THE UK, BECOME PAYABLE IMMEDIATELY UPON ACCEPTANCE OF ONE OF OUR AU PAIRS. IN THE CASE OF OVERSEAS PLACEMENTS, FEES ARE PAYABLE IN CLEARED FUNDS, IN ADVANCE BEFORE ANY DETAILS CAN BE SUPPLIED. PAYMENT OF OUR FEES WILL BE CONSTRUED AS AUTOMATIC ACCEPTANCE WHETHER THE TERMS & CONDITIONS OF BUSINESS ARE SIGNED OR NOT – AS IS AN EMAIL ACKNOWLEDGING ACCEPTANCE OF THE TERMS AND CONDITIONS OF BUSINESS. ALL FEES ARE NON-REFUNDABLE AND A 6 MONTH CREDIT NOTE WILL BE ISSUED IN THE EVENT OF THERE NOT BEING A SUITABLE AU PAIR REPLACEMENT AVAILABLE. Our fees are an introduction for the Au Pair. After the 10-week guarantee period, we cannot replace an Au Pair for free. Any accounts that are not paid within 30 days, for whatever reason, will incur interest at the current legal rate. Costs of recovery will be added to the amount of the original invoice value. Au Pairs are responsible for their own airfares, however; the family must either meet their Au Pair at the airport or any other arrival point into the Country. Arrangements can be made with the Agency for any arriving Au Pair to be collected from the Airport or Station, which is for the account of the family. Should the family live outside the Greater London area in the case of UK placements, then the family must reimburse the Au Pair for the travel fare from London to the main station of the nearest town to their home, where they will meet her. In the case of overseas placements, Au Pairs are responsible for airfares to the country of placement but this is negotiable, especially in long-distance travel, as airfares are expensive! Families overseas must take responsibility for getting the au pair from point of arrival to their home. Au Pairs in the UK must be paid minimum of £55/65, Au Pair Plus a minimum of £65-£85 and Mothers Help £100-£150 per week. Pocket money must be paid weekly and in full, directly to the Au Pair, in cash, one week after arrival. In the case of overseas placements, the equivalent of the above rates must be paid in the local currency, or the going rate in the country of residence. The Au Pair must be paid fairly for the amount of hours that he/she is working for the family - working hours being the time that he/she has to be available for the family (thereby preventing the Au Pair from going out and having free time). Pocket money may vary from country to country depending on the going rate in that country. LIABILITY A & A domestic recruitment, inc. Angels International Au Pairs cannot be held liable for any misrepresentation by the Au Pair or the Agency abroad supplying the Au Pair, loss, damage or injury caused to any persons or property, including third parties, whether with intention or by accident. TERMINATION Two weeks notice must be given to the Au Pair should the family wish to terminate the agreement between themselves and the Au Pair. If the family wishes the Au Pair to leave the family home on short notice, then the family is liable for hostel/hotel accommodation for the au pair for a minimum of 4 nights. In the event of serious misconduct by the Au Pair or the host family, either party shall be entitled to terminate the engagement with immediate effect. In the event of such misconduct on the part of the Au Pair, we will endeavour to arrange accommodation elsewhere for the Au Pair. If the Au Pair departs as a result of misconduct on the part of the family, A & A domestic recruitment/Angels International Au Pairs has no obligation to replace the Au Pair. No refunds at any stage will be undertaken. If, at any stage during the first ten weeks, your Au Pair proves to be unsuitable, A & A domestic recruitment /Angels International Au Pairs will undertake to provide an alternative Au Pair at no further charge, providing A & A domestic recruitment/Angels International Au Pairs accepts the reason for the au pair's dismissal. In the event of the Family cancelling an Au Pair once it has been agreed (whether in writing or verbally), the Family will be liable to pay the Agency administration fee of £100.00 or in the case of overseas placements £200.00. One week's paid holiday shall be offered to the Au Pair after completion of a six-month period with the family. If a family goes on holiday without the Au Pair, then the family is responsible for providing accommodation and food for the Au Pair and the Au Pair is still entitled to her pocket money. Should the Au Pair request extra holidays (especially during periods such as Christmas), we request that the family try to be as flexible as possible, as preventing the Au Pair may encourage bad feelings. Should the au pair be required to travel with the family, the family is responsible for all the au pair’s travel costs.
